At April 1 2013, the new Dutch Tender Act has taken effect. It contains the European rules that are applied to the Dutch situation.
Important parts of the new tender act are:
- The principle of proportionality – this stipulates that the requirements set in the tender have to be proportional with the order.
- No order clustering – this has to make sure that independent workers without employees and the SMBs get better changes for government orders.
- Own declaration – by issuing the own declaration when registering, the tendering party does not have to issue all evidence when registering.
